Geographical Indication Registration in Turkey
‘‘Geographical indications are the names or signs that indicate a product which has become identical with a locality, area, region, or nation it originally resides in, in terms of a distinctive feature, title and other qualities. In response to the question of what is geographical indication registration, we can respond in the following way: Geographical indication registration can be defined as providing the right to conduct and use a product by a single person in the face of the state, which allows the real or legal persons to protect the products known by the name of a specific geographical region or area.’’
Origin name: Indicates that all or the essential features of a product are derived, produced and processed from the human and natural factors of this region and other structured operations are carried out entirely within these territorial boundaries.
Indication of Source: Refers to the fact that a product has a distinctive reputation or other characteristics that have become identical with this region or have been produced and processed in this region and that at least one of the production operations takes place within the specified region.
After carrying out the necessary conditions for the protection of a sign as a geographical indication, you must first apply to our Sistem Patent company to process the application. All transactions will be carried out by us on behalf of you.
In Turkey, there are some documents that we need to be able to apply. These documents are:
- Application petition: It should provide information about the identity of the applicant's owner.
- Name of the product: The name of the product that is related to the name of the origin or the indication of source to be registered.
- Definition of the Product: The technical documentation and information describing the chemical, physical, microbiological and similar qualities of the product and, if needed, the raw material.
- Production Site: Documents and information identifying and determining what is within the geographical area of the region or region.
- Production Method: Information describing in detail the forms of activity, marking, signing, or labeling of the registered name of the origin name or of the indication of source.
- Distinctive features of the product: The features that differentiate the product from other products.
- Product Usage
- Independent control mechanism: The team that will examine the product.
As Sistem Patent, for geographical sign application filed by related parties for products which meet the requirements; we will present the relation of the product with the qualities that distinguish it from other products, the mode of production, the geographical borders it is produced and the geographical region in a manner supported by details and scientific reports.
The Institute may request additional information and documents from the applicant if it is needed during the examination of the application we have made, and may request that it be included in the opinion of the public, private institutions or organizations.
Upon the completion of the examination, applications that are appropriate in terms of conditions are published in the Official Gazette and in the local newspaper on the product. If the product is to be covered as an indication of source, it will be published in one of two newspapers with the highest readership across Turkey. This publication lasts six months. People who are related to the subject within the period of this announcement may appeal to the Institute on all matters related to the content of the advertisement text. With the objection, either the application is rejected or the notice of the new text is published. This announcement is not open for objection. Following the appeal process, the registration of applications which has been published or for which no objection has been made is completed and these applications are recorded in the Geographical Indication Register.
