Trademark licensing in Turkey is the process of renting the right of use of a registered trademark to another person. The trademark leasing, which takes place under the initiative of our Trademark and Patent registration and consultancy company, is carried out in two different ways. These are exclusive licenses and non-exclusive licenses which are in accordance with the provisions contained in the license agreement to be executed between the owner of the trademark and the lessor.
Exclusive license: The owner of a trademark cannot use his trademark as long as he does not explicitly retain the trademark rights, nor can he license it to other persons. If this is clearly stated in the contract, this type of lease will be entered in the exclusive license form.
Non-Exclusive License: If a provision is not attached to the agreement, or if there is a clause in which the trademark owner can use the registered trademark itself or a license is granted to other persons, this license is a non-exclusive license type. The license agreements may be on behalf of all products or services of the registered mark, as well as on a number of (partial) products. This situation must be clearly stated in the contract.
